Fit It On - Terms of Use

Please read these Terms of Use ("Agreement" or "Terms") carefully before using any services provided by FitItOn. This Agreement governs your access to and use of the FitItOn website, related services, features, content, and any applications we offer (collectively, "Services"). By accessing or using the Services in any manner, you agree to be bound by these Terms, including the Privacy Policy incorporated here, which explains how we handle your personal data.

Acceptance of Terms of Use

The Services are available to you subject to your acceptance of these Terms, which include all other operating rules and policies published by FitItOn. Occasionally, specific services may be subject to additional terms, which are incorporated here by reference. These Terms are binding and any use of our Services constitutes acceptance of these Terms.

FitItOn reserves the right to modify or discontinue offering the Services to any person or entity at our discretion, and to change eligibility criteria at any time. These Terms do not apply where prohibited by law, and in such cases, you are not authorized to access or use the Services.

Changes to Terms and Service Availability

FitItOn reserves the right, at its sole discretion, to modify or replace any of these Terms of Use, or change, suspend, or discontinue the Service (including without limitation, the availability of any feature, database, or content) at any time. Changes will be made by posting a notice on the FitItOn website or directly communicating them to you via email. We may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability.

It is your responsibility to regularly check the Terms of Use for changes. Your continued use of the Service after any modifications indicates your acceptance of the new Terms.

User Eligibility and Responsibilities

You must be at least 18 years old, or the minimum age of digital consent in your jurisdiction, to use the Services. Users under this age must have the Agreement approved by a parent or guardian who agrees to be bound by these Terms and is responsible for all activities of the minor.

Rules and Conduct

By using the FitItOn services, you agree to use them solely for lawful and permitted purposes. You must have explicit consent to use images of individuals or rights to use product photos.

You are prohibited from using the Service in any manner that:

• Violates any applicable laws, rules, or regulations.
• Infringes on the intellectual property or other rights of any person or entity.
• Is threatening, abusive, defamatory, deceptive, invasive of privacy, or objectionable.
• Exploits or harms minors in any way.
• Spreads false information or promotes violence.
• Generates or shares explicit content, especially involving minors.
• Interferes with, disrupts, or imposes an unreasonable load on the Service or infrastructure.
• Violates the integrity or security of the Service.

You are responsible for any content you upload or actions taken, and you must not upload harmful software or sensitive personal info. FitItOn reserves the right to monitor and take legal action against violations.

Shopify App and Merchant Responsibilities

If you install or use our Shopify app (shopify.fititon.app), you must ensure you have a lawful basis and any required consents to send us customer data. Do not send sensitive or special-category personal data in free-form metadata fields. You are responsible for complying with Shopify API and Partner terms when using our app and for providing accurate information about your store and its customers.

You will send only the minimum data needed for try-on and merchant analytics and will honor customer consent and opt-out choices (including “sale/sharing” opt-outs where applicable).

Data Handling and Security (Shopify)

Shopify customer/store data we receive is used only to provide merchant-facing analytics, support, security, and service operations. We do not sell or use Shopify customer data for advertising. We apply access controls, encryption in transit and at rest (including backups), role-based access with periodic review, access logging with periodic audit, environment separation (no production customer data in test or staging), data loss prevention controls (egress restrictions, monitoring/alerting, code reviews), and strong password/SSO (and MFA where available) requirements for staff who need access. Only authorized personnel may access production data for support/operations and access is revoked when no longer required. You must safeguard your API keys and restrict staff access to authorized personnel.

Incident Response

We maintain a documented security incident response plan. If we become aware of an incident affecting Shopify customer data, we will notify you without undue delay with the scope, impact, and remediation steps.

Retention and Deletion for Shopify Data

We retain Shopify customer events and store API request logs while your store is connected and for a limited period afterward (typically up to 180 days) for security, auditing, and troubleshooting, then delete or de-identify them unless law requires longer retention. Uninstalling the app stops further ingestion and triggers scheduled deletion. You may request earlier deletion through [email protected].

Encrypted backups follow a rolling retention schedule; expired backup copies are purged on rotation. Deletion requests are applied to active data and flow through backups as those backups age out.

Compliance with Shopify Policies and Redactions

Access to protected customer data is subject to Shopify approval and may be limited or redacted. If certain fields (for example, phone or address) are denied or redacted, related features may be reduced and we will operate without those fields. You agree to cooperate with any Shopify reviews related to protected customer data.

Processor Role and Data Protection Addendum

For Shopify customer data, we act as a processor/service provider to you as the controller/merchant. We will sign a data protection addendum upon request. If we become aware of a security incident affecting Shopify customer data, we will notify you without undue delay.

Intellectual Property Rights and Licensing

All logos, trademarks, patents, and content are owned or licensed by FitItOn or their respective owners. You receive a limited, non-exclusive license to use the Services consistent with these Terms.

By contributing content, you grant FitItOn a royalty-free, irrevocable license to use it to operate and improve the Services.

Links to and From Other Websites

Links on the FitItOn site may lead to third-party websites which FitItOn does not control. FitItOn is not responsible for their content or policies.

You may link to our site only in ways that do not imply endorsement or misuse of trademarks.

Fees and Payments

FitItOn offers subscription services billed monthly. By subscribing, you agree to immediate access without a withdrawal period. You may cancel anytime, but refunds for prior payments are not provided. Prices and taxes may change, and delinquent payments may suspend service.

Termination

FitItOn may terminate your access for violations. Termination ends your rights to use the Services, but some legal provisions survive termination.

Indemnification

You agree to indemnify and hold FitItOn harmless from any claims or damages arising from your use or misuse of the Services.

Limitation of Liability and Disclaimer

Services are provided “as is” without warranties. FitItOn is not liable for indirect or consequential damages, and liability is capped at the greater of $500 or your last 12 months’ payments.

Some limitations may not apply in certain jurisdictions.

Dispute Resolution by Binding Arbitration

You and FitItOn agree to resolve disputes by binding arbitration, waiving rights to court trials except for small claims. Details on arbitration procedures, location, and opt-out options apply.

General Provisions

These Terms are the entire agreement. Severability, assignment, and notices rules apply as described herein.
